Here are a few of the frequently asked questions we receive.

Under the Individual Sponsorship option (Option 1), How do I receive my commissions? (see upper right corner of webpage)

Since Southwest Realty Advisors, LLC is the sponsoring broker of record who holds your salesperson license, per the State of Texas requirements any commissions earned by the salesperson are paid to the sponsoring broker of record. However, In order to obtain your commission the quickest way possible, we authorize you to receive your commission payable at closing. The steps for this are as follows:

  1. Once a property is under contract you the agent will need to log in to our transaction management portal “BackAgent”.
  2. Within the “BackAgent” (see upper right corner of webpage) portal you will be required to upload all the applicable documents of the transaction which satisfy our compliance requirements. The specific documents required are identified within “BackAgent.”
  3. After all required documents have been uploaded, our office staff will review. If all documents are in compliance we will approve your transaction and will then generate our Company “CDA” form(Commission Disbursement Authorization). The CDA form identifies all the applicable details of the transaction such as the Buyers, Sellers and Closer at the Title Company.
  4. We will then forward the signed CDA over to the indicated closer at the Title Company as well as cc you on the email so all parties are on the same page. The CDA will then authorize you to be paid directly at closing.

Should the Title Company not allow a disbursement in your name, once we receive the funds/check we will deposit the commission check in our company operating account. Once this clears we will write you a check for your commission. Please note, the only time this usually happens is when the CDA has not been uploaded prior to closing. In this case the title company has no instructions and therefore the commission checks get sent directly to the Brokerage on Record.

Under the Individual Sponsorship option (Option 1A, 1B, 1C, and Revenue Sharing), who is listed as the Listing or Other Broker on the Texas Contracts?

Southwest Realty Advisors is acting as your sponsoring broker. Any contracts should reflect this.

Under the Individual Sponsorship option (Option 1A, 1B, 1C and Revenue Sharing) how are my listing signs displayed?

The Texas Real Estate Commission requires the name of the listing Broker to be displayed on all signs (TRELA 1101.652(b) (23). You can still include your and contact information but must also include Southwest Realty Advisors (your sponsoring broker) somewhere on the sign. We do provide and allow the use of our signage & logo for Southwest Realty Advisors in various formats (jpeg, png, svg, eps etc.) which can be used how you see fit for your marketing needs.

Under the LLC Sponsorship Option (Option 2), how are my signage and business cards displayed

In order to comply with TREC regulations the name of the sponsoring brokerage needs to be displayed on all marketing materials to include business cards and listing signs. Since the Brokerage is in the name of your company which in turn sponsors your salesperson license, the name of your company can be displayed. This allows you to brand yourself and your company!

Is Errors & Omissions Insurance provided?

Yes. We do carry our own E & O Insurance which is a blanket coverage based on total company revenues and applies to all agents sponsored by our LLC, Southwest Advisors. Under Option 2 however you must provide your own company E&O Insurance.

Is office space provided?

No, your physical office address is determined by you. Many agents may choose to open their own offices or work from home. If you intend to conduct business from an office location where you meet with the public to transact business, TREC requires the broker (Southwest Realty Advisors) to obtain a Branch Office license for this location. (Rule 535.112). The fee for this application is $20.

How long am I obligated to stay sponsored?

There are no contract or time frame requirements. You can leave at any time. Simply inform us of your desire to no longer remain sponsored and we will fill out TREC form Notice of Salesperson Sponsorship Termination.

What local Board of Realtors and Multiple Listing Services is Southwest Realty Advisors, LLC a member of?

Our company is always looking to expand into new markets within the State of Texas. We are currently members of the “Austin Board of Realtors”, “Houston Association of Realtors”, “MetroTex Association of Realtors”,  “Ft. Hood Area Association of Realtors”, “San Antonio Board of Realtors” & “Odessa Board of Realtors”. If we are not currently a member of your local Board of Realtors, we will explore the feasibility of joining at your request.

Where do I get the company forms, logos, signage etc. that I need to get started as an agent?

Our transaction management portal is powered by “BackAgent”. Upon sign up you will receive an email from BackAgent which will contain your credentials to this portal. Here is where you will find the Company Form Library with all the company templates as well as the Company Policy & Procedure Manual, Company Brokerage license, Company E&O Policy, Company W9, and Links to training videos that will tell you how to use the system and how to set up your own personal website etc. This is also where you will go in the event of a Closing or Lease to upload your documents for internal review and approval.

Under the LLC Sponsorship Option (Option 2), How do I receive my commission?

Your commission will be paid directly to your company by the title company. There is usually no need for a CDA to be signed by the broker under Option 2 since the brokerage name/license is the company that you own therefore any commissions can be paid to the brokerage. You in turn can deposit this in your company operating account and if applicable distribute your commission splits to your agents.
